The current legislation by which Public Administrations govern their Open Data projects is as follows:

Community scope

  • Directive 2003/98 / EC  of the European Parliament and of the Council, of November 17, 2003, on the reuse of public sector information.
  • Directive 2013/37 / EU  of the European Parliament and of the Council, of June 26, 2013, amending Directive 2003/98 / EC on the reuse of public sector information.
  • Directive 2016/2102  of the European Parliament and of the Council, of October 26, 2016, on accessibility of websites and applications for mobile devices of public sector bodies.

State scope

  • Royal Legislative Decree 1/1996 , of April 12, through which the text of the Intellectual Property Law is approved.
  • Organic Law 15/1999 , of December 13, on the Protection of Personal Data.
  • Law 27/2006 , of July 18, regulating the rights of access to information, public participation and access to justice in environmental matters (incorporates Directives 2003/4 / CE and 2003/35 / CE).

  • Royal Decree 1720/2007 , of December 21, through which the Regulations for the development of Organic Law 15/1999 on the protection of personal data are approved.
